Terms of Service

These Terms of Service (“Terms”) govern your use of the Fisherina mobile application (the “App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, in accordance with these Terms and with the Apple Licensed Application End User License Agreement (EULA). Where these Terms conflict with Apple’s standard EULA, the terms more protective of the rights holder apply to the extent permitted by law.

2. Subscriptions and purchases

The App may offer auto-renewing subscriptions or other in-app purchases.

All purchases are processed by Apple and are also subject to Apple’s terms. Refunds are handled by Apple according to its policies.

3. Acceptable use

You agree not to misuse the App, including by attempting to reverse engineer it (except as permitted by law), interfering with its operation, or using it for any unlawful purpose. You are responsible for complying with all applicable laws while using the App, including fishing and boating regulations.

4. Your content

Content you create or add — such as catches, photos, notes, and spots — remains yours. We do not claim ownership of it. You are responsible for the content you create and for having the right to use any photos you add.

5. Important disclaimers

Fisherina is a tool for guidance and entertainment. It is not a substitute for your own judgment, official sources, or professional advice. Always fish responsibly and safely.

Fish identification

Species identification uses machine-learning models and may be inaccurate or incomplete. Do not rely on it to determine whether a fish is legal to keep, safe to eat, or protected. Always verify before keeping or consuming any fish.

Regulations

Any fishing-regulation information in the App is provided for general reference only, may be outdated or incomplete, and is not legal advice. You are solely responsible for knowing and following the fishing laws, seasons, limits, and licensing requirements that apply where you fish.

Forecasts, measurements and tools

Solunar scores, bite forecasts, barometric trends, and weight/size estimates are predictions or approximations and are not guaranteed. Length and weight estimates from a photo are approximate — only a tape measure and scale give true figures. The bite-alarm and barometer tools are aids only and should not be relied upon where accuracy or safety is critical.

6. Intellectual property

The App, its design, and its original content are owned by the developer and protected by intellectual property laws. Certain content is provided by third parties under their own licenses — including species recognition based on Fishial (MIT), regulation data from U.S. state agencies and NOAA Fisheries, and fish imagery from Duane Raver / USFWS and Wikimedia Commons — and remains the property of its respective owners.

7. Disclaimer of warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or accurate.

8. Limitation of liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Apple-specific terms

These Terms are between you and the developer only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Termination

These Terms apply until terminated. Your rights under these Terms end automatically if you fail to comply with them. You may end them at any time by deleting the App.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Your continued use of the App after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Poland, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence provide otherwise.
